Terms of service

These terms govern the use of www.bombastik.games (the “Website”), operated by Ocio PPN, S.L. (“Bombastik”, “we”), with registered address at C/ Plaza República del Ecuador, 3 5D, 28016 Madrid, Spain.

Browsing the Website means you accept these terms. If you do not accept them, please do not use the Website.

01. Purpose of the Website

The Website is an informational and commercial presentation of the immersive entertainment concepts we license, and a channel through which operators and investors can request information about them.

Nothing on the Website is an offer. It is not a franchise offering document, a prospectus, an investment recommendation, or an invitation to enter into a contract. No licence, franchise or territory is granted, reserved or promised by using this Website or by submitting an enquiry through it. Any commercial relationship between you and Bombastik arises exclusively from a written agreement signed by both parties.

02. Figures, projections and performance information

The Website publishes figures relating to investment, revenue, operating margin and payback for our concepts. You should read them as follows:

  • Figures described as modelled are illustrative projections. They describe how a venue is expected to perform under a set of assumptions, and those assumptions will not hold identically in any other market.
  • Figures described as historical correspond to the past performance of a specific venue in a specific period. Past performance of one venue is not a forecast of the performance of another.
  • All figures are stated before taxes and before any charges specific to a market, and exclude working capital, financing costs and pre-opening expenses unless expressly stated.
  • Figures vary materially by country, city, location, building, operator and calendar. Currency amounts are stated in the currency shown and are not converted.

We do not guarantee any revenue, margin, payback period, return on investment or opening date. The venue, the capital expenditure, the operations plan and the rollout capacity of each candidate are assessed individually before any terms are agreed, and the terms that result may differ from any figure published here.

You should form your own view, with your own advisers, before committing capital.

03. Intellectual property

The Website and its contents — including the Bombastik!, BuzzAttack, Boom Lab, 123Boom! and Glow Or Go names and logos, texts, photographs, video, software, and the design and structure of the Website — are owned by Ocio PPN, S.L. or licensed to it, and are protected by intellectual and industrial property law.

You may view and print content for your own use in evaluating a licence. Any other reproduction, distribution, public communication, transformation or commercial exploitation requires our prior written authorisation.

04. Third-party trade marks

The Website reproduces the names and logos of media outlets that have published articles about our concepts. Those marks belong to their respective owners and are used here solely to identify the source of that coverage, in accordance with Article 14(1)(c) of Regulation (EU) 2017/1001. Their use does not imply any association with, sponsorship by, or endorsement from those outlets.

If you own one of those marks and prefer it not to appear, write to [email protected] and we will remove it.

The Website links to venue websites and to ticketing platforms operated by third parties. We do not control those sites and are not responsible for their content, their availability, or the terms and privacy practices that apply to them.

06. Enquiries and personal data

Data submitted through the enquiry form is processed as described in our privacy policy. Do not send confidential or commercially sensitive information through the form; use it to open a conversation, and we will agree a suitable channel from there.

07. Availability

We aim to keep the Website available and its content current, but we do not warrant uninterrupted availability or that the content is free of errors or omissions. We may modify, suspend or withdraw any part of the Website without notice.

08. Liability

To the fullest extent permitted by law, Bombastik is not liable for any loss arising from the use of the Website or from reliance on the information published here, including any decision to commit or not to commit capital. Nothing in these terms limits liability that cannot be limited under Spanish law.

09. Changes

We may update these terms. The version published on the Website at the moment you use it is the version that applies.

10. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute will be submitted to the Courts and Tribunals of Madrid, save where consumer legislation provides otherwise.
